Addleshaw Goddard advises PGE on acquisition of FEW Bałtyk II and environmental assets for Baltica 9

"Addleshaw Goddard acted as Polish counsel and Linklaters LLP as lead counsel to PGE Polska Grupa Energetyczna S.A. and its Baltica 9 subsidiary in transactions to acquire 100% of RWE Offshore Wind Poland (developer of FEW Bałtyk II, ~350 MW) and environmental assets for the Baltica 9 project (975 MW), enabling participation in a support auction."

Addleshaw Goddard acted as Polish counsel to advise PGE Polska Grupa Energetyczna S.A. (including its Baltica 9 sp. z o.o. subsidiary) in the transaction, and Linklaters LLP acted as lead counsel for PGE; the seller was the RWE group. Baltica 9 sp. z o.o., a PGE Group company, committed to acquire 100% of the shares in RWE Offshore Wind Poland sp. z o.o., the developer of the FEW Bałtyk II offshore wind project with an installed capacity of approximately 350 MW. The FEW Bałtyk II project is adjacent to the Baltica 9 project and benefits from a contract for difference, location permits and a permit for laying and maintaining cables (PUUK). Concurrently, Baltica 9 entered into an agreement to acquire environmental assets, including the Environmental Decision (Decyzja o Środowiskowych Uwarunkowaniach), necessary to participate in the auction to obtain the right to cover the negative balance for electricity generated by the offshore wind farm and fed into the grid. As a result of winning that auction, the Baltica 9 offshore wind project with a capacity of 975 MW (area 44.E.1) will proceed.
