KEC International Limited Writ Petition Before the Hon’ble Gauhati High Court

"Khaitan & Co represented KEC International Limited in a writ petition before the Hon’ble Gauhati High Court, Itanagar Bench, seeking refunds of tax assessments for 2015–16 to 2017–18 and statutory interest on delayed refunds for 2013–14 and 2014–15 under the Arunachal Pradesh Goods Tax Act, 2005. The Court ordered release of refunds and interest."

Khaitan & Co represented KEC International Limited in a writ petition before the Hon’ble Gauhati High Court, Itanagar Bench. The petition sought refunds of tax assessments for the assessment periods 2015–16 to 2017–18 and statutory interest on the delayed payment of refunds for the assessment years 2013–14 and 2014–15 under the provisions of the Arunachal Pradesh Goods Tax Act, 2005 (the Act). Counsel for the petitioner argued that the Act imposes a statutory, non‑discretionary obligation to grant refunds and that an assessee is entitled to statutory interest where refunds are not issued within the prescribed period. The Hon’ble Court accepted these submissions, holding that the statutory provisions of the Act mandate refunds be released within one month and that, if not so released, interest computed daily at the prescribed rate becomes payable. The Court directed the respondents to release all admitted and accepted refund claims together with statutory interest within four months from receipt of the certified copy of the judgment.
