Rhineland-Palatinate government and parliament prevail in dispute over municipal financial equalization

OPPENLÄNDER Rechtsanwälte represented the state government and state parliament of Rhineland-Palatinate, together with the Ministry of the Interior and the Ministry of Finance, in proceedings before the Administrative Court of Koblenz brought by two municipalities challenging the State Financial Equalization Act. The Administrative Court of Koblenz dismissed the lawsuits and declined to refer the matter to the Constitutional Court of Rhineland-Palatinate or the Federal Constitutional Court. The court found that the amendments to the State Financial Equalization Act enacted at the end of 2022 complied with constitutional requirements and properly implemented the guidance set out by the Constitutional Court of Rhineland-Palatinate in its ruling of 16 December 2020. OPPENLÄNDER convinced the administrative judges in Koblenz that the legislature had acted in conformity with those requirements. OPPENLÄNDER is continuing to represent the state of Rhineland-Palatinate in further proceedings, including matters pending before the Administrative Court in Neustadt an der Weinstraße, where it is defending the constitutionality of the State Financial Equalization Act against model lawsuits filed by counties, cities and municipalities. In addition, OPPENLÄNDER is conducting proceedings on behalf of another state government to defend municipal financial equalization before that state's constitutional court.
