L&B Partners Prevails at TAR Lazio on Extension of Expropriation Deadlines for Combined‑Cycle Gas Power Plant

L&B Partners Avvocati Associati represented the counterinterested company in proceedings before the Regional Administrative Tribunal of Lazio (TAR Lazio), opposing an appeal brought by the Province against a decree issued by the Ministry of the Environment and Energy Security. The TAR Lazio (Third Section), in judgment no. 22029/2025 published on 5 December 2025, held inadmissible the appeal filed by the Province against Ministerial Decree no. 55/3/2025 PR of 3 February 2025. That decree extended, among other measures, the expropriation deadlines originally established by the Single Authorisation for a planned combined‑cycle thermoelectric power plant fuelled by natural gas to be located in the Campania region. The Tribunal observed that, notwithstanding the Province's status as an institutional body expressing the local community and hence supra‑individual interests, the appeal could not proceed. The court accepted the defence advanced by the counterinterested company, finding that recognising the Province's standing would effectively permit it to substitute itself for the landowners subject to expropriation. Those landowners, the court noted, hold only a differentiated and qualified interest in protecting their rights, and the Province may not assert their specific grievances on their behalf.
