Barnes & Thornburg Secures Dismissal of Michigan PFAS Suit Against Commercial Airport

"Barnes & Thornburg, with co‑counsel Earth & Water Law, represented a commercial airport in defending a Michigan attorney general’s PFAS enforcement action alleging contamination from firefighting foam. Barnes & Thornburg and Earth & Water Law represented the commercial airport defendant in a PFAS enforcement action brought by the Michigan attorney general. In the first and only case filed by a state attorney general against a commercial airport alleging PFAS (per‑ and polyfluoroalkyl substances) contamination from firefighting foam, a Barnes & Thornburg team led by partner Charles Denton obtained dismissal of the state’s complaint by the trial court. The ruling disposes of the enforcement action against the airport at this stage. Earth & Water Law served as co‑counsel in the defense of the airport.
