Court orders Police and Border Guard Board to review Tigris Nõgols' firearms licence extension

COBALT represented Tigris Nõgols in litigation against the Estonian Police and Border Guard Board (PPA) concerning the extension of a firearms licence. Holders of firearms licences are required to submit an application to the PPA by the statutory deadline, including a medical certificate and all other requisite documents. Due to an unexpected illness and prolonged medical waiting times, Tigris Nõgols submitted the required materials after the deadline. The PPA refused to consider the extension application, concluding that no valid reason existed for the late submission. Tigris Nõgols challenged the PPA’s decision in court, arguing that the delay was justified by illness and lengthy medical queues and that such circumstances did not warrant refusal of the licence extension. Both the Administrative Court and the Circuit Court agreed with Nõgols: they annulled the PPA’s decision and ordered the PPA to review the extension application.
