Trevisan & Cuonzo Represents Morello Forni before the Unified Patent Court

Trevisan & Cuonzo represented Morello Forni in proceedings before the Unified Patent Court against a Swedish company and its Italian reseller. On 19 November, the Unified Patent Court (TUB) issued a first‑instance decision in the dispute brought by Morello Forni, maker of restaurant and pizzeria equipment, concerning its dough‑sheeting machine Pizzarella. The court granted an immediate injunction prohibiting the manufacture, offering for sale and commercialisation of the infringing product on the market, ordered the withdrawal of counterfeit products from all commercial channels, and required publication of the decision. The judgment further obliges the losing parties to provide financial information necessary to reconstruct the distribution chain and to quantify damages, which will be determined in subsequent proceedings. The TUB decision has effect in 18 countries covering a large portion of the main European markets. The outcome demonstrates how the new unified system enables SMEs to protect their rights on a wide scale through a single action, benefiting from a rapid, unitary and effective procedure that simplifies enforcement and reduces costs compared with separate national actions. The concentration of litigation investment also allows SMEs to instruct highly specialised legal and technical advisers to achieve the best possible results.
