The law firm Alma LED represented the Consorzio Turistico di Pescia Romana before the Council of State in an administrative appeal resulting in a favourable ruling. The Consorzio Turistico di Pescia Romana, assisted by counsel from Alma LED, obtained a significant decision from the Council of State, Fourth Section, with the judgment deposited on 25 November 2025. The court recognised the consortium’s full standing to bring an action concerning the protection of urbanisation works and the correct siting of infrastructures provided for in subdivision agreements. The Council of State clarified that, by virtue of the consortium’s statutory duties to construct and maintain urbanisation works, the Consorzio holds a qualified and distinct legal position sufficient to ground its legitimacy to challenge building titles issued without the necessary verifications regarding the availability of land. The judgment also reiterated the obligation of municipal administrations to conduct adequate inquiries when disputes arise over land availability, thereby reinforcing principles of legality and correctness in administrative action. The ruling constitutes an important precedent for the protection of consortia and the proper management of territory.
