LGV Avvocati Obtains EU General Court Wins in Sandokan Trademark Proceedings

"LGV Avvocati secured two favourable rulings at the EU General Court in trademark proceedings concerning the SANDOKAN mark, defending Lux Vide (part of the Fremantle Group). The Court upheld EUIPO's assessments, dismissed the appeals and reaffirmed principles of genuine use, good faith and mark validity. Metroconsult and Fremantle’s in-house legal team supported the matter."

LGV Avvocati and Metroconsult acted for Lux Vide, a company of the Fremantle Group, with support from Fremantle’s in-house legal team led by Manuela Monterossi. LGV Avvocati obtained two important decisions before the General Court of the European Union in proceedings concerning the trade mark SANDOKAN, brought to protect the interests of Lux Vide, the Fremantle Group company that produced the new TV series inspired by the character created by Emilio Salgari and soon to be broadcast on Rai. In both rulings the Court confirmed the correctness of the European Union Intellectual Property Office’s (EUIPO) assessments, dismissed the appeals and reiterated fundamental principles of EU trade mark law, including the requirements of genuine use, good faith and the validity of the sign. These outcomes strengthen the protection of intellectual property rights connected to a high-profile audiovisual project and represent an important endorsement of LGV Avvocati’s legal approach.
