Employment Law Crisis Advice for Deutsche Lufthansa AG During the COVID-19 Pandemic and Strategic Collective Bargaining Support

Seitz represented Deutsche Lufthansa AG and its group subsidiaries, including Germanwings GmbH and Lufthansa Technik, on employment-law matters arising from the group’s Covid-19 restructuring. In 2020 Seitz was mandated to implement the employment-law aspects of the extensive group restructuring required as a consequence of the Covid pandemic, encompassing a variety of restructuring projects across the group’s companies and divisions. The firm negotiated an extensive voluntary programme for Lufthansa pilots to address the expected reduction in air traffic in 2020 and advised on crisis collective agreements for both cockpit staff and ground staff. Seitz negotiated the closure of Germanwings GmbH in 2021 and subsequently succeeded in enforcing a so-called Social Plan Zero in court. The firm also took a leading role in advising on the reorganisation of pilot training at Lufthansa, including the closure of the flight school in Bremen. Group subsidiary Lufthansa Technik likewise relied on Seitz’s counsel in a Germany-wide restructuring project. Seitz provided ongoing support in collective bargaining with labour union Vereinigung Cockpit e.V. Following a collective agreement concluded in 2022, the parties reached a long-running collective bargaining agreement in the summer of 2023 that extends until the end of 2026.
