BIP Law and Tax and BIP Group Assist SAC in State Aid Compatibility Procedure for Development Plan of Comiso Pio La Torre Airport

"BIP Law and Tax, together with the BIP Group, assisted airport operator SAC in securing European Commission validation (case SA.120942) of the Comiso Pio La Torre Airport development plan, enabling the use of €47 million in FSC funds for upgrades including a strategic cargo area. The plan complies with EU state aid rules under Article 56b of Regulation (EU) 651/2024 and stems from the 27 May 2024 Cohesion Agreement."

BIP Law and Tax and the BIP Group represented SAC (the airport operator) in the European Commission procedure to obtain formal validation of state aid compatibility for the development plan of Comiso Pio La Torre Airport. Regional technical bodies and the Permanent Representation of Italy to the EU participated in the process alongside the client. The European Commission, through formal validation entered on the SANI2 system (case SA.120942), certified that the Comiso Pio La Torre Airport development plan is compatible with EU state aid rules under Article 56b of Regulation (EU) 651/2024. The operation mobilises €47 million of FSC (Fondo per lo Sviluppo e la Coesione) resources to strengthen the Sicilian airport, with particular emphasis on the construction of a cargo area identified as a strategic infrastructure for the local logistics system. The development plan forms part of the Cohesion Agreement signed on 27 May 2024 between the Italian Government and the Sicilian Region. With the European institutions' validation, the plan was found to meet the parameters required by state aid legislation, enabling the deployment of significant public funds to enhance the airport.
