BIP Law and Tax Advises SAC in State Aid Compatibility Proceeding for Comiso Airport Development Plan

BIP Law and Tax advised SAC (Società Aeroporto di Comiso), with support from the Gruppo BIP consultancy team, in the state aid compatibility proceeding concerning the development plan for Comiso Pio La Torre airport. The European Commission, through formal validation on the SANI2 system (case SA.120942), certified that the Comiso airport development plan complies with EU state aid rules pursuant to Article 56‑bis of Regulation (EU) 651/2024. The operation activates €47 million of FSC (Fondo per lo Sviluppo e la Coesione) resources allocated to the enhancement of the Sicilian airport, with a particular focus on the development of a cargo area identified as strategic infrastructure for the regional logistics system. The redevelopment plan for the Ragusa province airport forms part of the Cohesion Agreement signed on 27 May 2024 between the Italian Government and the Sicilian Region. The European validation confirmed that the plan meets the parameters set by state aid legislation, thereby permitting the deployment of significant public resources for the airport’s upgrade. BIP Law and Tax represented SAC (Società Aeroporto di Comiso) with a team composed by: partners Francesca Isgrò and Claudio Costantino, assisted by lawyers Antonino Castorino and Gabriella Galioto. The firm supported SAC in preparing and conducting the administrative procedure to verify the compatibility of the public aid with the applicable sector rules, in coordination with regional technical bodies and the Permanent Representation of Italy to the EU. Gruppo BIP represented SAC (Società Aeroporto di Comiso) with a consulting team composed by: partners Antonio Iuculano and Francesca Baiocchi, supported by Federico Buccetti and Dylan Bottin. The team prepared the Economic and Financial Plan used to assess the profitability of the investments to be made by the Sicilian Region and SAC, ensuring compliance with EU state aid constraints.
