Lexia obtains DURC from the Court of Como for Il Faro Servizi in negotiated corporate crisis; Capitalink serves as financial advisor

Lexia and Capitalink – Corporate Finance participated in the matter: Lexia assisted Il Faro Società Cooperativa S.r.l. on legal matters, while Capitalink acted as financial advisor to the same company. The transaction arose in the context of a negotiated composition of the crisis initiated under Article 12 et seq. of the Italian Code on Negotiated Crisis Resolution (CCII). The Court of Como issued an order in favour of Il Faro Società Cooperativa S.r.l., a facility management operator with established experience in public and private cleaning and sanitation contracts, directing the release of the Documento Unico di Regolarità Contributiva (DURC). The ordinance granted Il Faro’s precautionary request seeking a measure to obtain recognition of contributory regularity and the issuance of a valid DURC for at least 120 days. The company records an exposure of approximately €8 million. The order is intended to facilitate business continuity, support implementation of the restructuring plan and ensure payments from public contracting authorities—elements considered central to the success of the negotiations under the composition procedure.
