Stibbe Successfully Challenges Belgian Jurisdiction in Online Criminal Offence Case

Stibbe represented a UK company accused of IT forgery, IT fraud and online defamation. Stibbe successfully defended the company by challenging the jurisdiction of Belgian courts in relation to alleged online offences. The central question was when an alleged online offence can be deemed to have been committed in Belgium and whether the mere presence of the alleged victim in Belgium is sufficient to confer jurisdiction. The court unequivocally endorsed Stibbe's position that, in this matter, the mere presence of the alleged victim in Belgium did not suffice to establish that the offence had been committed there, and the proceedings were brought to an end.
