Slaughter and May represents Vodafone in Competition Appeal Tribunal ruling that bars pre-2015 standalone damages claims

Slaughter and May represented Vodafone Limited and Vodafone Group PLC in certification proceedings before the Competition Appeal Tribunal. The Tribunal's judgment, handed down on 14 November 2025, has substantially curtailed the class action that was permitted to proceed to trial against various mobile operators. The class representative had sought damages reaching at least as far back as 1 January 2007 in a claim originally said to be worth over £3 billion. In its ruling the Tribunal accepted the operators' argument that the applicable transitional rules prescribe a two-year limitation period for stand-alone claims that arose before 1 October 2015 but were commenced in the Tribunal after that date. As a result, the class representative's claims for damages arising before 1 October 2015 were struck out as time barred. This is the first detailed ruling on whether stand-alone damages claims arising before 1 October 2015 can be pursued before the Tribunal. By finding for the operators, the Tribunal confirmed the temporal limits on the claims that class representatives may bring under the collective action regime that came into effect on 1 October 2015.
