EY assists DPS in first simplified concordato approved by the Court of Nola

"EY Studio Legale Tributario advised DPS Delivery Package Service in a negotiated crisis composition and a subsequently approved simplified concordato by the Court of Nola — the first homologation of the new crisis-management instrument by that court. The liquidatory plan divided creditors into classes, downgraded privileged claims and provided creditor recovery through external mixed financing consisting of assets in kind and segregated cash. The plan was drafted by Sossio Lupoli and certified by Domenico Angrisani."

The firm assisted DPS, a long-established company operating in sub-transport of goods in the Campania region, in a negotiated composition of the crisis and in the subsequent simplified concordato which has recently been homologated by the Court of Nola. This ruling constitutes the first approval by the Court of Nola of the new simplified instrument for crisis management. The homologated concordato, of a liquidatory nature, provided for the classification of all creditors into distinct classes, the downgrading of privileged creditors and the satisfaction of creditors through the injection of external mixed financing. That financing was composed of assets in kind and segregated monetary availability, enabling distributions to creditors under the approved plan.
