A&A – Albè e Associati represented Riva e Mariani Group. A&A – Albè e Associati assisted Riva e Mariani Group, a company active for years in the thermal and acoustic insulation sector, in several precautionary proceedings concerning the collective transfer of a number of employees assigned to a production site in the Sicily region. The transfers arose from a difficult and complex corporate reorganization implemented by the company. The proceedings were handled as urgent matters. The Court of Gela found that Riva e Mariani Group’s decision to transfer part of its personnel was well founded, having identified the staff to be transferred on the basis of concrete technical, organizational and productive requirements that were properly indicated and expressed. The court confirmed the measures adopted by the company, which were directed, among other objectives, at safeguarding employment even if that employment continued at a location different from the Sicilian site. The court orders that concluded the urgent proceedings also emphasized the employer’s compliance with principles of fairness and good faith. The employer demonstrated that it had fulfilled its obligations regarding the criteria used to select the workers subject to transfer.
