Freshfields Prevails in Challenge to Block Delaware Permit-to-Purchase Gun Law

"Freshfields represented the State of Delaware and Attorney General Kathy Jennings in opposing a gun lobby motion for a preliminary injunction to block Delaware’s permit-to-purchase handgun law, which requires a permit and gun safety training. A federal judge denied the injunction and the law took effect on November 16, 2025; the case is on appeal to the Third Circuit."

Freshfields represented the State of Delaware and Attorney General Kathy Jennings in opposing a gun lobby motion for a preliminary injunction seeking to block Delaware’s permit-to-purchase handgun law. On November 14, 2025, Freshfields successfully argued against the motion for a preliminary injunction. The challenged statute requires individuals to obtain a permit and complete gun safety training before purchasing a handgun in Delaware. A federal judge denied the motion for injunctive relief, and the law took effect as scheduled on Sunday, November 16, 2025. Delaware Attorney General Kathy Jennings, in thanking Freshfields for its assistance, said, “This is not just a win for the State – it's a win for everyone who has been impacted by gun homicide, gun suicide, or gun trafficking.” The matter is now pending on appeal to the Third Circuit Court of Appeals.
