Offenbach Hospital Operator Ketteler Krankenhaus Initiates Debtor-in-Possession Restructuring

PLUTA Rechtsanwalts GmbH and PLUTA Management GmbH assisted Ketteler Krankenhaus gemeinnützige GmbH in initiating in-court debtor-in-possession restructuring proceedings, while HGW Rechtsanwälte was appointed by the Local Court of Offenbach as provisional insolvency monitor for the case. Ketteler Krankenhaus gemeinnützige GmbH has applied for and obtained provisional debtor-in-possession status from the Local Court of Offenbach to secure the hospital’s long-term financial stability and to improve the sustainable provision of medical services in Offenbach. The proceedings will enable the company to implement necessary restructuring measures independently, under professional guidance, with the objective of stabilising its finances and repositioning its service offering in response to structural pressures in the healthcare sector. Under the arrangement, PLUTA Rechtsanwalts GmbH will support management as general agents. The court has appointed attorney Dr Lason Gutsche of HGW Rechtsanwälte as provisional insolvency monitor to oversee the proceedings in the interests of creditors. Patient care will continue throughout the process: all departments remain operational, scheduled treatments and operations proceed as usual, and the emergency department remains open. Management has already taken direct measures, including the appointment of experienced manager Dietmar Eine from Hospital Management Group GmbH to the management team. Staff of more than 900 employees have been informed and wages are protected by statutory substitute benefits under German insolvency law. Ketteler Krankenhaus traces its roots to outpatient services and the 1905 founding of Krankenhaus Josefsheim; the current facility on Lichtenplattenweg dates from 1958. Today the non-profit operator runs a modern 310-bed hospital specialising in surgery, internal medicine, gynaecology, obstetrics and geriatric care, is part of a regional care network for Frankfurt/Offenbach, holds KTQ certification, has received the German Palliative Seal and serves as a teaching hospital for Goethe University Frankfurt. The operator also runs a hospice funded by daily care fees and donations, with donated funds used exclusively for that purpose. The company attributes its need for restructuring to broader sector pressures: an inadequate funding structure in the German healthcare system combined with rising personnel and material costs that have put many hospitals under substantial financial strain. Through debtor-in-possession management, the hospital intends to stabilise its finances and further develop its medical services in a targeted manner.
