Knights secures High Court victory as client awarded multi‑million‑pound NHS clinical waste contracts

Knights represented Sharpsmart Limited, with counsel from Keating Chambers instructed to assist. The dispute concerned a large NHS procurement in which 24 Integrated Care Boards (ICBs) tendered clinical waste collection and disposal services for primary care. The contracts were five-year awards, with an option to extend for up to a further four years, and were said to have a combined value of about £168 million, with the procurement described as the largest ever clinical waste exercise in the UK. Sharpsmart bid for 17 lots and was awarded 13. The incumbent provider challenged the awards, arguing defects in the procurement process, which led to suspension of the awards under the Public Contracts Regulations 2015. After a two-day hearing in the High Court in London, Mr Justice Waksman ordered the suspensions lifted following successful applications by the ICBs and consideration of evidence and submissions from the incumbent provider, the ICBs and interested party Sharpsmart. The judgment permits the original awards to proceed, enabling Sharpsmart and the ICBs to advance planned operational, financial and sustainability benefits across the services awarded.
