Alston & Bird Secures Two Federal Circuit Affirmances of ITC Patent Victories

"Alston & Bird obtained two Federal Circuit affirmances of U.S. ITC rulings. For Resideo, Itron and Ademco the court upheld the ITC’s no‑violation finding and found the asserted patent invalid. In a separate appeal for Helen of Troy (d/b/a Pur Water filters) the court affirmed that Brita’s patent is invalid for lack of written description and enablement."

Alston & Bird represented Resideo, Itron and Ademco in one appeal and Helen of Troy (d/b/a Pur Water filters) in a separate appeal at the U.S. Court of Appeals for the Federal Circuit. In the first appeal, the Federal Circuit confirmed Alston & Bird’s ITC victory for Resideo, Itron and Ademco. The court found the asserted patent invalid, upheld the International Trade Commission’s finding of no violation, and rendered the appeal moot. In the second, unrelated appeal, the court affirmed the ITC’s determination regarding Helen of Troy (d/b/a Pur Water filters). The Federal Circuit agreed that Brita’s patent was invalid for lack of written description and enablement, effectively concluding that the patent did not claim what Brita actually invented.
