Cuesta Secures Appellate Ruling for Magellan in Estonia Export‑Licensing Dispute

Cuesta represented Magellan in proceedings before the Tallinn Court of Appeal in an administrative dispute against the Estonian Tax and Customs Board and the Strategic Goods Commission under the Ministry of Foreign Affairs. The appellate court issued its decision at the end of September in proceedings arising from Magellan’s claim for damages and related requests. The Court of Appeal considered Magellan’s applications for a declaration that no export licence was required and for findings on the unlawfulness of the Strategic Goods Commission’s delay in processing the company’s licence application. The underlying damages action, through which Magellan seeks compensation for losses it says were caused by the delayed handling of its licence request, remains pending before the Tallinn Administrative Court. In light of the appellate ruling, Magellan contends that new grounds and prospects have emerged for adjudicating its damages claim, which is premised on the contention that the application was not reviewed within a reasonable time.
