Arnold & Porter Secures Arbitration Victory for Panama in Panama Canal Expansion Dispute

"Arnold & Porter represented the Republic of Panama in an UNCITRAL arbitration brought by Spain-based Sacyr SA concerning the Panama Canal expansion. The tribunal, seated under UNCITRAL rules, rejected Sacyr’s claims on the merits and ordered Sacyr to pay Panama nearly $6.4 million in costs."

Arnold & Porter represented the Republic of Panama in arbitration proceedings brought by Spain-based Sacyr SA. The dispute arose from an investment arbitration initiated in 2018, in which Sacyr alleged that Panama had violated the Panama–Spain Bilateral Investment Treaty during the bid process and subsequent execution of a project that formed part of the Panama Canal expansion. On October 31, an UNCITRAL-seated tribunal rejected all of Sacyr’s claims on the merits and ordered Sacyr to pay Panama costs of the proceedings totaling nearly $6.4 million.
