"Getty Images has won a significant legal case in the UK against Stability AI, with the High Court ruling that Stability AI's use of Getty Images' trademarks in AI-generated outputs infringed those trademarks. The court held Stability AI responsible for the infringement, rejecting the argument that users should bear the responsibility. Additionally, the ruling confirmed that Getty Images' copyright-protected works were used to train Stability AI's model, setting a precedent that AI models are subject to copyright infringement claims. Getty Images calls for stronger transparency regulations to protect creators' rights and prevent costly legal disputes."

Fieldfisher’s Intellectual Property team represented Getty Images in its litigation against Stability AI in the UK. The transaction involved a legal dispute where Getty Images claimed that Stability AI's use of its trademarks in AI-generated outputs infringed its intellectual property rights. The High Court ruled in favor of Getty Images, confirming that Stability AI was responsible for the infringement due to its control over the images used to train its AI model, Stable Diffusion. The ruling also established that AI models are subject to copyright infringement claims, setting a significant precedent for intellectual property law.
