Ashurst advised Faktus in the structuring and establishment of the Fonds Commun de Titrisation (FCT) Faktus Financement, an innovative transaction aimed at providing tailored financing solutions to companies in the construction and services sectors. The newly launched FCT will enable Faktus to mobilize additional financial resources to support the growth of its clients by facilitating access to alternative financing and optimizing cash flow management. This will be achieved through the granting of loans directly by the FCT, secured by the assignment of receivables for the benefit of the FCT. Ashurst's involvement covered all legal and regulatory aspects related to the structuring of the fund, negotiation of contractual documentation, and coordination with various stakeholders, including the management company, investors, and financial partners. The Ashurst team was led by Agathe Motte (partner), assisted by Aurélien Fournier (counsel), both specializing in structured finance in Paris.
