HOYNG ROKH MONEGIER, led by Dr. Christine Kanz, in cooperation with Bristows, led by Brian Cordery, advised and represented Novo Nordisk A/S in enforcing its patent and regulatory rights during the CPHI pharmaceutical trade fair in Frankfurt am Main, Germany. The transaction involved Novo Nordisk successfully obtaining 29 ex parte preliminary injunctions against companies infringing its patent EP 1 863 839 B1 and regulatory rights. The Düsseldorf Regional Court issued 26 injunctions against exhibitors offering the active pharmaceutical ingredient Semaglutide and/or Semaglutide-containing pharmaceuticals, while the Frankfurt Regional Court issued three injunctions against exhibitors offering finished medicinal products containing Semaglutide without valid marketing authorization, constituting unfair competition law violations. These injunctions were promptly served on-site during the trade fair and are effective immediately. All defendants retain the right to appeal the orders.
