Specifically, in ruling no. 803/2025, the Cgars fully reformed the first-instance ruling and annulled a negative VIA Decree that had expressed environmental incompatibility concerning a project for the construction of a wind farm of approximately 30MW. The ruling annulled the VIA Decree and the advisory opinion of the Superintendency for Cultural Heritage, as the administrations had only issued negative opinions on the entire project despite the identified issues being limited to a few wind turbines. Furthermore, the ruling allowed the economic operator to propose alternative technical solutions. Additionally, the ruling annulled Article 3 of the D.P.R.S. dated October 10, 2017, which classified all areas with cultural and landscape assets as unsuitable for the construction of renewable energy plants.
