Global law firm Freshfields represented London & Southeastern Railway (LSER) and Govia Thameslink Railway (GTR) in a significant legal victory. The case involved a long-running class action before the Competition Appeal Tribunal that commenced in 2019. The Tribunal ruled unanimously that LSER and GTR did not violate competition law in their marketing and sale of specific train tickets known as “boundary fares.” This judgment clarifies the distinction between competition law and consumer law, affirming that dominant companies are not obligated to structure their businesses to ensure optimal purchasing decisions for all customers.
