Federal Court Rules Against Compensation for Quarantine Losses Due to Unvaccinated Status

"On October 9, 2025, the Federal Administrative Court ruled that an individual who lost earnings while in quarantine due to a COVID-19 infection in October 2021 cannot claim compensation from the state under the Infection Protection Act. The court determined that the individual had the opportunity to avoid quarantine by getting vaccinated, which was publicly recommended at the time. This decision overturned previous lower court rulings that had ordered the state to pay compensation, as the court found that the vaccination's effectiveness, even at 72%, was sufficient to consider the infection avoidable."

On October 9, 2025, the law firm OPPENLÄNDER Rechtsanwälte represented the state of Baden-Württemberg in a significant legal proceeding concerning compensation claims under the Infection Protection Act. The Federal Administrative Court ruled that an employed person who was quarantined in October 2021 due to a coronavirus infection could not claim compensation from the state if they had not taken the publicly recommended vaccination despite having sufficient opportunity to do so. The court overturned previous lower court rulings that had ordered the state to pay compensation, determining that the plaintiff could have avoided infection and isolation through vaccination, which was deemed effective against the virus. The lawyers involved in this case from OPPENLÄNDER Rechtsanwälte included Dr. Malte Weitner, who specializes in litigation and state liability under the Infection Protection Act, and Dr. Maximilian Stützel, who focuses on public law and constitutional law.
