Baker Botts Secures Complete Victory for Pro Bono Clients in Trademark and Copyright Dispute

Espinoza, No. 4:23-CV-2914, S.D. Tex.), securing a complete victory after a settlement for Espinoza and a bench ruling denying the plaintiffs’ requests for damages, injunction and fees."

Baker Botts LLP represented Jacqueline G. Espinoza and Estilo Isabella LLC in litigation arising from alleged trademark and copyright claims brought by Viann’ K Mansur LLC in the U.S. District Court for the Southern District of Texas (Viann’ K Mansur LLC v. Estilo Isabella LLC and Jacqueline G. Espinoza, Case No. 4:23-CV-2914). Baker Botts entered the matter shortly before trial. The firm used pretrial motion practice and negotiations to secure a favorable settlement for Jacqueline G. Espinoza and continued to defend Estilo Isabella LLC against the plaintiffs’ remaining claims for damages and other relief. After multiple rounds of briefing and a three-hour evidentiary hearing that included live witness testimony and closing arguments, U.S. District Judge Ewing Werlein Jr. ruled from the bench, denying the plaintiffs’ requests for damages, a permanent injunction and attorneys’ fees.
