BakerHostetler Secures Dismissal of Six-Count Class Action Against CRH Healthcare

BakerHostetler represented CRH Healthcare in litigation in the U.S. District Court for the Northern District of Georgia, with a team led by Partner Christopher Wiech and Associates Georgia Bennett and Savannah Avera. Plaintiff Jane Doe, et al., brought a putative class action asserting six counts against CRH Healthcare—negligence, breach of fiduciary duty, breach of implied contract, breach of express contract, unjust enrichment and violations of the Electronic Communications Privacy Act—alleging that personal information was transmitted to third parties, including Google, following installation of certain web-based technologies on CRH Healthcare’s website. CRH Healthcare operates health clinics and a website that allows patients to schedule appointments, locate treatment facilities, pay bills, search medical specialties and obtain telehealth services. BakerHostetler successfully argued a motion to dismiss, which the court granted on all six counts without prejudice. In dismissing the claims, the judge concluded the plaintiff’s allegations failed to explain what damages were actually suffered as a result of the defendant’s actions.
