Arnold & Porter represented The Chemours Company in its settlement with the U.S. Environmental Protection Agency to resolve claims relating to per- and polyfluoroalkyl substances (PFAS). The settlement resolves EPA assertions concerning PFAS discharges and other alleged non-compliance actions, primarily at Chemours’ facilities in New Jersey, North Carolina, and West Virginia. It is the first comprehensive federal agreement with a major manufacturer of PFAS substances. The agreement provides greater clarity for the industry on future compliance requirements and actions to support long-term responsible manufacturing while acknowledging Chemours’ role in producing critical materials for military and commercial use.
