Ferox Legal Secures Full Dismissal of Director Liability Claim at OLG Karlsruhe

"Frankfurt firm Ferox Legal represented a former managing director in an appeal before the OLG Karlsruhe, obtaining full dismissal of a nearly €7 million liability claim brought by an insolvency administrator after an adverse first-instance ruling. The court found the insolvency administrator's depiction of insolvency unconvincing despite reliance on a private expert report."

The Frankfurt law firm Ferox Legal represented a former managing director in an appeal before the Higher Regional Court (OLG) Karlsruhe against organ liability claims brought by an insolvency administrator. At first instance the District Court (Landgericht) Karlsruhe had granted the insolvency administrator’s claim in full, ordering the former managing director to pay nearly EUR 7 million. On appeal the OLG Karlsruhe fully dismissed the action against the director whom Ferox Legal represented. The OLG Karlsruhe agreed with Ferox Legal’s position that the insolvency administrator’s presentation of an alleged inability to pay by the later insolvent company was unconvincing, even though the administrator relied on a private expert report said to be based on the company’s bookkeeping. During the appeal process Ferox Legal was able to identify and demonstrate numerous contradictions and inconsistencies in the administrator’s case. Ferox Legal represented the former managing director with a team composed by: partner Harald C. Knittel, who led the appeal and had already handled the mandate at his previous firm before continuing representation at Ferox Legal.
