Barnes & Thornburg Secures Favorable DOJ Antitrust Resolution for OhioHealth

Barnes & Thornburg represented OhioHealth in negotiations with the U.S. Department of Justice and the Ohio attorney general to resolve an antitrust lawsuit concerning language in certain managed care contracts. Under the agreement announced on June 16, 2026, OhioHealth does not admit any wrongdoing and maintains that its contracting practices were and are lawful and appropriate. OhioHealth will not pay penalties, fines or damages. The settlement remains subject to approval by the U.S. District Court for the Southern District of Ohio. The contract provisions at issue date back as far as two decades and were originally intended to protect OhioHealth from insurer practices common at that time. The healthcare and insurance industries have since evolved, and OhioHealth says it routinely renegotiates agreements with insurers in a competitive market. The DOJ and the Ohio attorney general filed suit in February 2026, alleging OhioHealth used its market power to restrict payer plan designs in the Columbus area. OhioHealth, based in Columbus, is a nationally recognized, not-for-profit, charitable healthcare outreach of the United Methodist Church. Serving communities since 1891, OhioHealth comprises 35,000 associates, physicians and volunteers and operates a network that includes 16 hospitals, three joint-venture hospitals, over 200 ambulatory sites and other health services across a 50-county area.
