Arnold & Porter Obtains Dismissal of Consumer Class Action Against Stanley Drinkware Over Alleged Lead in Tumblers

"Arnold & Porter won dismissal of a consolidated consumer class action against Pacific Market International LLC (maker of Stanley drinkware) in the U.S. District Court for the Western District of Washington. The court held plaintiffs failed to allege a specific, plausible risk of harm from a small lead pellet used to seal the vacuum insulation at the cup base, and found an amended complaint did not cure prior deficiencies. The firm’s team was led by partners James F. Speyer, E. Alex Beroukhim, Pallavi Mehta Wahi and Ashley E. Gammell."

Arnold & Porter represented Pacific Market International LLC, the maker of Stanley drinkware. The firm secured dismissal of a consolidated consumer class action in the U.S. District Court for the Western District of Washington alleging the company failed to disclose the use of lead in its tumblers; the court held the plaintiffs failed to plead a specific and plausible risk of harm from the small lead pellet used to seal the vacuum insulation layer, found the amended complaint did not cure defects identified in an earlier dismissal, and concluded that without plausible allegations of harm any disclosure claim was moot. The Arnold & Porter team included partners James F. Speyer, E. Alex Beroukhim, Pallavi Mehta Wahi, and Ashley E. Gammell; counsel Elie Salamon; and associates Owen Connolly and Nina Leviten (seniorities as listed; the press release does not specify practice areas).
