Buchanan Secures Win as ITC Finds Mexican Winter Strawberry Imports Injure U.S. Industry

"Summary: On February 27, 2026 the U.S. International Trade Commission (ITC) issued a preliminary affirmative determination that imports of fresh winter strawberries from Mexico have likely materially injured the U.S. domestic industry. The finding follows an antidumping petition filed December 31, 2025 by the Strawberry Growers for Fair Trade and relies in part on a rarely used regional industry analysis. The U.S. Department of Commerce opened antidumping investigations on February 10, 2026 and is expected to announce preliminary dumping margins by the end of June; if Commerce’s and the ITC’s final determinations are affirmative (likely in early 2027), antidumping duties would be imposed for at least five years. The petitioner is represented by Buchanan, led by Daniel B. Pickard and a multi‑member legal team."

Buchanan represented the Strawberry Growers for Fair Trade (SGFT) in an antidumping petition concerning imports of fresh winter strawberries from Mexico. The petition, filed December 31, 2025, asked the U.S. International Trade Commission (ITC) and the U.S. Department of Commerce to impose antidumping duties on Mexican winter strawberry imports. On February 27, 2026 the ITC issued a preliminary affirmative determination that such imports reasonably indicate material injury to the domestic industry, clearing the way for Commerce’s ongoing antidumping investigation (initiated February 10, 2026). Commerce is expected to issue preliminary antidumping determinations at the end of June 2026; if it reaches an affirmative preliminary determination, U.S. Customs and Border Protection would begin collecting duties based on those margins. The ITC’s final phase is likely in early 2027, and if both agencies issue affirmative final determinations, antidumping duty orders would be imposed for a minimum of five years (with five‑year reviews thereafter). The petition also relied on a regional industry analysis, a seldom-used provision that may affect other seasonal and regional agricultural producers. The Buchanan team was led by Daniel B.
