BakerHostetler Secures Second Dismissal of Class Action Against Associated Wholesale Grocers Over 2023 Employee Data Breach

"BakerHostetler announced on March 3, 2026 that it secured a second dismissal of a proposed class action against Associated Wholesale Grocers (AWG) stemming from an October 2023 data breach that exposed personal data for 26,579 employees. U.S. District Judge Eric F. Melgren dismissed Patterson v. AWG on Feb. 12, 2026 for lack of standing to allege injuries (e.g., identity theft, anxiety, lost time, loss of privacy); a prior suit, Jenkins v. AWG, was dismissed for lack of standing on March 5, 2025. Partner Casie Collignon, Counsel Jason Orr and Associate Colby Everett represented AWG in both matters."

BakerHostetler represented Associated Wholesale Grocers, Inc. in defending against class action litigation arising from a 2023 data breach. The firm successfully defended two proposed class actions alleging that an October 2023 incident exposed personal information for 26,579 current and former AWG employees (names, birth dates, and Social Security numbers). The earlier suit, Jenkins v. Associated Wholesale Grocers, was dismissed by U.S. District Judge Daniel D. Crabtree on March 5, 2025 for lack of standing; a second suit, Patterson v. Associated Wholesale Grocers, was dismissed by U.S. District Judge Eric F. Melgren on February 12, 2026 for lack of standing to support the alleged injuries (past and future identity theft; fear and anxiety; lost time, annoyance and inconvenience; and loss of privacy).
