Andersen Italia represents Silvelox Group in recovery of silvelox.nl domain

Andersen Italia represented Silvelox Group in proceedings before the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center to recover the domain name silvelox.nl. The domain silvelox.nl had been registered and maintained without authorization by a former distributor of Silvelox Group, who refused to transfer titularity following the termination of the distribution relationship. Silvelox Group, which specialises in the design, production, marketing and installation of bespoke automatic and armored door solutions, sought recovery of the domain through WIPO proceedings. Andersen’s IP department handled the entire procedure from the preliminary pre-litigation phase through to execution of the decision. The activity was conducted in coordination with the firm’s Litigation & Arbitration department. The WIPO decision reaffirms that a distribution relationship, whether exclusive or non-exclusive, does not by itself entitle a distributor to register or use a domain name incorporating the manufacturer’s trademark absent the manufacturer’s express authorization. This is particularly the case where the distribution agreement has been terminated: termination extinguishes any right to use or retain a domain containing another party’s trademark regardless of any prior authorization.
