Simpson Thacher Advises Gresham House on First Guernsey Natural Capital Fund Designation for Biodiversity Creation Strategy

Simpson Thacher & Bartlett advised Gresham House in obtaining the Guernsey Financial Services Commission's designation of its biodiversity creation strategy as a Natural Capital Fund under the Guernsey Natural Capital Fund Rules. The designation marks the first fund to achieve the Natural Capital Fund status under the Guernsey regime. Gresham House's strategy will invest in a diversified portfolio of biodiversity and natural capital projects designed to deliver measurable and verifiable ecological outcomes that either positively contribute to, or significantly reduce harm to, the natural world. The strategy is intended to support the biodiversity targets of the Kunming‑Montreal Global Biodiversity Framework. Simpson Thacher leveraged its sustainable finance expertise to ensure the fund's natural capital objectives were translated to meet cross‑jurisdictional regulatory requirements, including the Guernsey rules and Article 9 of the EU Sustainable Finance Disclosure Regulation (SFDR). The fund has now been formally granted Natural Capital Fund status by the Guernsey Financial Services Commission, representing a significant step in Gresham House's natural capital and sustainable infrastructure strategy. The Guernsey regime is the world's first regulated natural capital and biodiversity investment fund designation, providing investors with enhanced confidence in governance, transparency and oversight.
