Deutsche Lufthansa AG Employment Law Crisis Advice During the COVID-19 Pandemic and Strategic Collective Bargaining

Seitz advised Deutsche Lufthansa AG and its group companies, including Germanwings GmbH and Lufthansa Technik, and worked with the labour union Vereinigung Cockpit e.V. on employment-law and collective bargaining matters arising from the COVID-19 crisis. In 2020 Seitz was mandated to implement employment-law measures required by the group restructuring necessitated by the pandemic. The firm negotiated an extensive voluntary programme for Lufthansa pilots to address the anticipated reduction in air traffic in 2020 and provided advice on crisis collective agreements for both cockpit staff and ground staff. Seitz negotiated the closure of Germanwings GmbH in 2021 and successfully enforced a so-called "Social Plan Zero" in court. The firm also led advice on the reorganisation of pilot training at Lufthansa, notably the closure of the flight school in Bremen. In addition, the group subsidiary Lufthansa Technik relied on Seitz's expertise for a Germany-wide restructuring. Seitz continued to support collective bargaining with Vereinigung Cockpit e.V.; following a collective agreement in 2022, the parties concluded a long-running collective bargaining agreement extending until the end of 2026 in the summer of 2023.
