Mr. Bergman brings more than 20 years of experience as a litigator and government enforcement lawyer. He joins Jones Day as a partner in the Health Care & Life Sciences Practice, drawing on extensive experience handling health-care fraud and related enforcement matters.
For the last 11 years Mr. Bergman served at the U.S. Attorney’s Office for the Southern District of New York, where he most recently was co-chief of the Civil Frauds Unit. In that role he supervised more than 150 active affirmative civil fraud cases, including health care fraud matters implicating the False Claims Act, the Anti-Kickback Statute, and the Stark Law, led significant enforcement actions against major pharmaceutical and medical device companies securing settlements totaling hundreds of millions of dollars, and supervised a False Claims Act trial victory resulting in a nearly $1 billion judgment.
Prior to joining SDNY, Mr. Bergman spent seven years at the New York State Office of the Attorney General’s Medicaid Fraud Control Unit, where he helped resolve the office’s first New York State False Claims Act case and served as a team lead on a $600 million multi-state settlement.
