Alston & Bird Expands Health Care Regulatory Practice with Partner Asher Funk in Chicago
"Alston & Bird adds partner Asher Funk to its Health Care Regulatory Team in Chicago. He will work on health care regulatory compliance, transactional and fraud-and-abuse matters, focusing on home health, hospice and behavioral health."
Funk advises health care and life sciences companies on transactional, regulatory, and fraud-and-abuse matters, with a practice focused on home health, hospice, and behavioral health providers. He works with private equity sponsors and their portfolio companies on mergers, and with health care providers and suppliers on operations, mergers, acquisitions, dispositions, and joint ventures across the continuum of care, including hospitals and health systems, skilled nursing and rehabilitation providers, and digital health platforms.
His experience includes advising on the Stark Law, Anti-Kickback Statute, and Civil Monetary Penalties Law, applicable state transaction laws, and matters involving the corporate practice of medicine, quality of care, medical necessity, billing, and reimbursement. He represents clients in self-disclosure to Medicare contractors and federal agencies, including HHS-OIG, CMS, and the Department of Justice; negotiates corporate integrity agreements; and handles False Claims Act matters.
Funk joins Alston & Bird at the partner level. The firm said he will strengthen its health care regulatory compliance practice, particularly in complex transactions and fraud-and-abuse matters. Funk said he was drawn to Alston & Bird because of its integrated, full-service health care practice and collaborative approach and is eager to work with colleagues in Chicago to advise clients on complex transactional, regulatory, and enforcement issues.
